TERMS AND CONDITIONS OF BUSINESS

These Terms and Conditions of Business (“Terms”) govern all transactions, services, and dealings between Bleyer Limited, trading as Bleyer Bullion (“Bleyer”, “we”, “us”, “our”) and any customer, client, seller, website user or other person dealing with us (“you”, “your”).
By accessing our website, requesting a quotation, placing an order, selling items to us, using our storage services, or otherwise dealing with us, you agree to be bound by these Terms.
1. COMPANY DETAILS

2. OUR BUSINESS
2.1. We are dealers in physical precious metals and related products.
2.2. Our principal activities include:
a) sale of investment-grade bullion bars and coins;
b) sale of accessories, storage products and safes;
c) secure storage and vaulting arrangements via third-party custodians;
d) purchasing bullion and precious metal items from customers and the public;
e) portfolio valuations;
f) facilitation of physical precious metals pension arrangements through third parties.
3. IMPORTANT RISK NOTICE
3.1. Precious metal prices can rise or fall materially and rapidly.
3.2. Bullion products are purchased primarily for metal content, market exposure and long-term wealth preservation considerations, not cosmetic perfection.
3.3. Past performance of gold, silver or other metals is not indicative of future performance.
3.4. You alone are responsible for your purchasing and investment decisions.
4. NO FINANCIAL, TAX OR LEGAL ADVICE
4.1. We are not regulated financial advisers unless expressly stated otherwise.
4.2. We do not provide investment advice, tax advice, pension advice or legal advice.
4.3. Any commentary, guidance or market views given by us are informational only.
4.4. You should obtain independent professional advice before entering any transaction if required.
5. CUSTOMER ELIGIBILITY
5.1. You must be at least 18 years old and legally capable of entering into binding contracts.
5.2. We may require proof of identity, address, source of funds, source of wealth or any other information reasonably required.
5.3. We may refuse to deal with any person or transaction at our discretion where lawful to do so.
6. PRODUCT DESCRIPTIONS
6.1. Products may include gold, silver, platinum, palladium, rhodium bars, coins, rounds, accessories, safes and related goods.
6.2 We endeavour to describe Products accurately, but specifications may vary due to mint changes, manufacturer updates or supplier substitutions.
6.3. Images are illustrative only unless expressly stated otherwise.
6.4. Coin dates, packaging, serial numbers, assay card styles and outer presentation may vary unless specifically guaranteed in writing.
7. BULLION QUALITY STANDARDS
7.1. Bullion products are valued primarily by weight, purity, recognisable brand and market tradability.
7.2 Bullion products may show minor marks, scratches, abrasions, tarnish, milk spots, handling marks or packaging wear.
7.3 Such characteristics are normal within the bullion trade and do not ordinarily constitute defects.
7.4. Cosmetic issues that do not materially impair authenticity, weight or purity shall not entitle return, rejection or compensation.
7.5. Products described as pre-owned, secondary market, ex-customer stock, damaged, impaired packaging or second quality shall be sold on that basis.
8. PRICING
8.1. Precious metal prices are linked to international live markets and may change without notice.
8.2. Prices shown on our website, advertisements or quotations are invitations to treat only and are not binding offers.
8.3. A legally binding contract is formed only when we expressly accept your order.
8.4. We may correct any obvious pricing, technical, clerical or feed error.
8.5. Where an error has occurred, we may cancel the transaction and refund sums paid.
8.6. We reserve the right to impose quantity limits or amend spreads during volatile markets.
9. ORDER PROCESS
9.1. Customers should be placing their own orders, in advance, online where possible.
9.2. Where difficulties occur we may assist via telephone, by email, or in person.
9.3. Once accepted, bullion orders may be immediately hedged, sourced or allocated by us and for that reason, cancellation rights may be limited or excluded.
9.4. We may reject, suspend or cancel any order before acceptance.
9.5. Our warehouse operates Monday to Friday, 9am to 5pm except for public holidays. Any placed outside of these times will be processed on the next working day or during busy periods as soon as possible.
10. PAYMENT TERMS
10.1. Payment methods may include: bank transfer; debit card; credit card; cash, subject to limits, legal requirements and our internal policy.
10.2. Full cleared funds must be received by the deadline specified by us.
10.3. If no deadline is specified, payment must be made immediately upon ordering.
10.4. Failure to make prompt payment entitles us, without limitation, to:
a) cancel the order;
b) reprice the order;
c) recover market losses;
d) retain deposits;
e) refuse future business.
10.5. Card payments may be subject to fraud screening.
10.6. We may refuse shipment to an address different from the registered cardholder address.
11. MARKET LOSS ON CUSTOMER DEFAULT
11.1. If you fail to complete a bullion transaction after placing or confirming an order, we may suffer losses due to market movement, hedging, procurement or administrative costs.
11.2. You agree to indemnify us for all reasonable losses, costs and expenses resulting from your default.
11.3. We may offset such sums against any monies or bullion held for you.
12. TITLE AND RISK
12.1. Risk in Products passes to you upon delivery, collection, or transfer into allocated storage in your name.
12.2. Legal title to Products remains with us until we receive full cleared payment of all sums due.
12.3. If payment is reversed, charged back or recalled, title shall remain or revest in us to the extent permitted by law.
13. DELIVERY
13.1. Delivery dates are estimates only.
13.2. We may use secure couriers, signature services, ID checks or collection procedures.
13.3. You must inspect Products promptly on receipt.
13.4. Any shortage, damage or discrepancy must be reported within 48 hours of delivery.
13.5. We are not liable for delays caused by couriers, customs, strikes, weather, security incidents or events beyond our control.
13.6. Bleyer insures packages whilst in transit.
13.7. We are unable to accept any liability for packages that have been delivered to houses of multiple occupancy, work addresses, PO boxes, a ‘safe place’, mail boxes or where a postal redirection is in place once signed for, or confirmed by our couriers as delivered to that address.
14. COLLECTION
14.1. Collection from Bleyer Limited may require advance appointment, ID verification and proof of purchase.
14.2. We will refuse release where identity or payment concerns arise.
15. STORAGE AND VAULTING
15.1. We may arrange storage through approved third-party custodians.
15.2. Unless otherwise stated, stored holdings are intended to be fully allocated.
15.3. Storage is subject to custodian operating rules, security procedures and access limitations.
15.4. Insurance may be arranged through the custodian or its insurers subject to their terms, exclusions and limits.
15.5. We do not independently guarantee insurer solvency or claim outcomes.
15.6. Storage fees and related charges must be paid when due.
15.7. If fees remain unpaid, we may suspend services and, after reasonable notice where practicable, sell sufficient holdings to recover outstanding sums and costs.
16. SELLING ITEMS TO US
16.1. We may purchase items from you whether originally supplied by us or not.
16.2. Any quotation is subject to inspection, testing, authenticity verification, weight confirmation and market conditions.
16.3. Final prices may differ from indicative quotes.
16.4. We may reject counterfeit, altered, suspicious, stolen, encumbered or unsuitable items.
16.5. You warrant that you have legal title and authority to sell the items to us.
16.6. It is your responsibility to ensure that items are securely packaged to eliminate in transit damage. Failure to do so could impact the final value of your item(s).
16.7. Responsibility only passes to Bleyer once items have been safely delivered to our premises.
16.8. We endeavour to complete all transactions during the same or next working day.
17. COUNTERFEIT OR SUSPICIOUS ITEMS
17.1. If any item appears counterfeit, unlawfully obtained or suspicious, we may retain it pending investigation and report the matter to relevant authorities where required by law.
17.2. We shall have no liability for complying with legal obligations in this regard.
18. VALUATIONS
18.1 We may provide informal or formal valuations.
18.2.We may charge fees for detailed valuations, written reports or extensive correspondence.
18.3. Valuations are opinions only and not guarantees of sale proceeds.
19. PENSIONS AND THIRD PARTIES
19.1 Pension or retirement arrangements involving bullion are facilitated through independent trustees, administrators, custodians or professional advisers.
19.2 Their separate terms, fees and regulatory obligations apply.
19.3 We are not liable for the acts, omissions or insolvency of independent third parties except where liability cannot legally be excluded.
20. CANCELLATIONS, RETURNS AND EXCHANGES
20.1. Due to the nature of bullion prices fluctuating in financial markets beyond our control, statutory cooling-off rights do not apply to bullion orders where exemptions exist under applicable law.
20.2. Once accepted, bullion orders are generally final.
20.3. If we agree to a cancellation, you shall pay any resulting market loss, supplier charge, payment processor fee and administration cost.
20.4. Non-bullion accessories may be returnable only in accordance with applicable consumer law, provided unused and suitable for resale.
20.5. Custom, special-order or personalised goods are non-returnable unless faulty.
20.6. Exchanges are at our discretion unless legally required.
21. CHARGEBACKS AND PAYMENT REVERSALS
21.1 If you initiate an unjustified chargeback or payment reversal, you shall indemnify us for the transaction amount, costs, fees, collection expenses and legal costs.
21.2 We reserve all rights to recover Products or sums due.
22. ANTI-MONEY LAUNDERING / KYC
22.1 We operate anti-money laundering, sanctions, fraud prevention and know-your-customer procedures.
22.2 You shall promptly supply all information reasonably requested.
22.3 We may delay, freeze, refuse or cancel any transaction pending satisfactory checks.
22.4 We may make disclosures to authorities where required by law.
22.5 We are not liable for delays caused by compliance checks.
23. WEBSITE TERMS
23.1 We do not guarantee uninterrupted access to our website.
23.2 We may suspend, modify or withdraw any website feature without notice.
23.3 You must not misuse the website, interfere with systems or attempt unauthorised access.
24. INTELLECTUAL PROPERTY
24.1 All website content, branding, text, graphics and materials remain our property or that of our licensors.
24.2 You may not reproduce or exploit any content without permission.
25. LIMITATION OF LIABILITY
25.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or liabilities which cannot lawfully be excluded.
25.2 Subject to clause 25.1, our aggregate liability arising from any transaction shall not exceed the amount paid by you for the relevant Product or Service.
25.3 We shall not be liable for:
a) loss of profit;
b) loss of opportunity;
c) market losses;
d) loss of savings;
e) reputational damage;
f) indirect or consequential loss.
25.4. We are not liable for losses caused by precious metal price movements.
25.5 When sending items to Bleyer:
a) it is the customer’s responsibility to contact us prior to sending anything for return or sale;
b) risk in products only passes to us upon safe receipt;
c) we cannot be held responsible for damage in transit when products are sent to us and
d) customers are responsible for the cost of postage and/or return postage, unless otherwise agreed in advance.
26. FORCE MAJEURE
26.1. We shall not be liable for delay or failure caused by events beyond our reasonable control including supplier failure, transport disruption, cyberattack, war, terrorism, strike, pandemic, natural disaster, market suspension or government action.
27. DATA PROTECTION
27.1. We process personal data in accordance with applicable UK data protection law.

28. TERMINATION OF RELATIONSHIP
28.1. We may cease dealing with you immediately where:
a) you breach these Terms;
b) payments are overdue;
c) compliance concerns arise;
d) abusive or threatening behaviour occurs;
e) fraud is suspected; or
f) we otherwise reasonably decide to discontinue the relationship.
29. GENERAL
29.1. If any provision is unenforceable, the remaining provisions remain in force.
29.2. Delay in enforcing rights is not a waiver.
29.3. These Terms constitute the entire agreement except for any separate written agreement signed by us.
29.4. We may amend these Terms from time to time by publication on our website.
29.5. The version in force at the time of transaction shall apply.
30. GOVERNING LAW AND JURISDICTION
30.1. These Terms are governed by the laws of England and Wales.
30.2. The courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory consumer rights.
